Bradford Council Approved an Amendment to Condition 5 but Omega is not happy with the decision so they are Appealing!

Sample Objection Points:

Condition 5 Amendment by the Council states:

5. i) Notwithstanding the provisions of Part 8 of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking, re-enacting or modifying that Order) no fixed plant and machinery shall be installed externally of buildings on the site.

ii) There shall be no outside storage of any plant, machinery goods or materials within the following areas:-
Area 1: within the area defined by a line drawn along the full length of the primary north north west elevation of the main building through to where this line intersects the perimeter bund to the east of the main building and for a distance of 38 metres along the full length of this line in a north north westerly direction.
Area 2: the elevated land adjacent to the perimeter bund to the south south east of the bio filter and main building.

Reason: In the interests of visual amenity and to ensure sufficient space is available for the manoeuvring of vehicles in the interests of highway safety in those outside areas and to accord with Policies GB1, NE3, NE3a and TM2 of the Replacement Unitary Development Plan.

The original Condition 5 as set out in 2002 and 2010 Appeal Planning Condition:
5) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking, re-enacting or modifying that Order), no further plant or machinery shall be placed or erected on the site without the prior written permission of the Local Planning Authority.

Bottom line, the removal of Condition 5 is contrary to National Planning Policy Framework guidelines, Para 120, Para 122 and Greenbelt Policies.

If this condition is removed, Omega will be able to erect, install and develop the site without our involvement. We know that the Environmental Permit and Pollution Control guidelines are not protecting us as they should.
